01Acceptance of these terms

These Terms of Use govern access to and use of Brickell Wallstreet Real Estate websites, applications, property information, communications and related services (the “Platform”). By creating an account or otherwise using the Platform, you agree to these terms.

02Account responsibilities

You are responsible for the accuracy of the information you provide and for all activity that occurs under your account.

• Keep your credentials confidential and notify us of any unauthorized use.
• Provide accurate contact information for tour requests and consultations.
• You must be of legal age to enter into a binding agreement in your jurisdiction.

03Permitted platform use

The Platform is provided for personal, non-commercial use in connection with genuine real estate interest, unless you have a separate written agreement with BWSRE.

• No scraping, crawling or bulk extraction of listing data.
• No reverse engineering, interference with, or circumvention of platform security.
• No use of the Platform for unlawful, misleading or discriminatory purposes.

04Property listing information

Listing details, pricing, availability, measurements and investment metrics are supplied by third parties or generated for illustration and may change without notice. Listing information is not a guarantee, appraisal, or offer, and should be independently verified before you rely on it.

05Intellectual property

The BWSRE name, logo, design system, software and original content are owned by Brickell Wallstreet Real Estate or its licensors and may not be copied or reused without permission.

06User-generated content

You retain ownership of content you submit and grant BWSRE a non-exclusive license to host, display and distribute it in connection with operating the Platform. You are responsible for ensuring that you have the rights to any content you submit.

07Third-party services

The Platform may link to or integrate services operated by others, including listing feeds, mapping providers, lenders and analytics tools. Those services are governed by their own terms and privacy practices.

08Professional relationships

Contacting an agent, broker, developer or property manager through the Platform does not by itself create an agency, brokerage or fiduciary relationship. Any such relationship must be established through a separate written agreement.

09Disclaimers

The Platform is provided on an “as is” and “as available” basis without warranties of any kind. BWSRE does not provide legal, tax, financial, appraisal or investment advice.

10Limitations of liability

To the maximum extent permitted by law, BWSRE is not liable for indirect, incidental, special, consequential or punitive damages, or for losses arising from reliance on listing information obtained through the Platform.

11Dispute resolution

Disputes relating to these terms will be resolved under the governing law identified in the final published agreement, including any applicable arbitration and venue requirements.

12Changes to the services

We may modify, suspend or discontinue features of the Platform, and may update these terms. Material changes will be reflected in the effective date above, and continued use constitutes acceptance.
